There is a conflict of interest if: a) Acting for one client causes the disclosure of confidential information received from another client; b) The lawyer’s knowledge of one client’s confidential information may give another client an unjust benefit; c) The past performance of duties for one client may restrict the lawyer’s impartiality when acting for another client.

According to legislation which is yet to be implemented by the Italian Minister of Economy and Finance, the lawyers of “Zagamilaw” must verify their clients’ identity, keep a record of their details and of any transaction involving the transfer of more than EUR12,500 (about US$15,850), and inform the authorities of suspicious transactions.

The lawyers of “Zagamilaw” will keep confidential all information received from their clients or any persons who have sought legal advice from them. We will never act without your authorization.

After obtaining written instructions from the client, “Zagamilaw” attorneys can hold client money on a fiduciary basis if necessary for the performance of their duties but only for as long as it is necessary to carry out the transaction.

Find out if the lawyer will agree to binding arbitration if a serious dispute arises between the two of you. Most state bar associations have arbitration committees that, for a fee, will settle disputes that you and your lawyer may have, say over expenses. By agreeing to binding arbitration, both you and the lawyer of “Zagamilaw” consent to present your cases to an outside panel and abide by its decision.

“Zagamilaw” is perfectly aware of the importance of cost control and for this reason our clients will always be informed of the exact costs related to their legal case. We specifically discuss with you and make fully clear the fees and costs you will be charged and you will get your fee agreement in writing with our letter of engagement. Our fees are regulated accordingly to the Italian decree n. 127/2004, and the total legal fees VAT at the rate of 20% shall apply to EU individuals and to non-EU companies and individuals.

Under the Italian National Tariff Table approved by the Minister of Justice tariffs are itemised in detail and depend on the activity performed and the claim or transaction value. It usually gives a minimum and maximum fee range within which lawyers can charge. At our first meeting, a “Zagamilaw” lawyer will estimate how much the total case will cost and inform you of the method we will use to charge for the work. Various types are allowed provided that they do not result in a final fee that is outside the minimum and maximum in the Italian National Tariff Table. We use an hourly fee, fixed fee or contingency fee depending on the case.
